ALVEA Yachts offers you legal support and tax advices from a network of experienced maritime lawyers and tax consultants, who will drive you smoothly, safely and discretely through the buying or selling process, the flag state and the regulatory bodies. The key-points in this process include first of all, the draw of a Memorandum of Agreement (MoA). The MoA is signed between the Seller and the Purchaser where all the parameters of the transaction will be included together with an inventory list. Another key step is the inspection/survey from a surveyor of the buyer’s choice who will check the general condition of the yacht and will draw a report for the potential buyer. ALVEA Yachts can always recommend independent surveyors for executing surveys. A sea trial is also recommended and is executed after a MoA is signed. During the sea trial, the yacht may require a gas consumption test, a haul in/haul out if it is ashore, etc. The cost for the sea trial burdens the buyer’s side, unless otherwise agreed. Furthermore, the Greek Law requires a certain bureaucratic procedure to be followed during the transaction, which however safeguards the interests of the Buyer and prevents any debts or any other financial burdens that could exist on the boat to follow the boat after the purchase. ALVEA Yachts collaborates with the most experienced maritime lawyers in Greece, who will perform the checking of vessel titles and documentation required by the Greek State and furnished by the Seller, inspection of registry files and finally monitor deletion procedure of boat from the Greek Registry. The cost for this service has to be covered by the buyer, or alternatively, the buyer can use a lawyer of his/her choice. The purchase procedure is completed with the signing of the Bill of Sale. The duration of this procedure, from signing of the Bill of Sale to deletion of the boat from the Greek Registry will normally takes approximately 2-4 weeks provided that unexpected problems will not arise. The yacht can be sailed by the new owner only after a Bill of Sale has been issued and officially signed by the Vendor as well as by the Buyer and also the Deletion Certificate has been issued. A yacht sold to a non E.U. Citizen does not require the payment of any outstanding VAT to the boat. It will require though the yacht to be custom cleared from the E.U.
